Terms of Service

Please read these Terms carefully. They set out the rules for using NutriWealth, important limits on our responsibility, and your rights and obligations. By using NutriWealth, you agree to them.
These Terms of Service (“Terms”) are an agreement between you and NutriWealth, a business based in Melbourne, Victoria, Australia (“NutriWealth”, “we”, “us” or “our”). They govern your use of the NutriWealth mobile application (the “App”) and our website at nutriwealth.app (the “Site”), together the “Service”.
If you don’t agree to these Terms, please don’t use the Service.
1. What NutriWealth is
NutriWealth is a nutrition app that does two things in one place: (1) Tracking — it helps you log food and track calories and macronutrients, and estimates targets based on information you provide; and (2) Scanning — it lets you scan a product barcode or photograph food to see general information about it, including a health score, nutrition breakdown, and an explanation of additives and ingredients. The information NutriWealth provides is general and educational. It is not personal advice and is not a substitute for professional guidance. Please also read our separate Health Disclaimer, which forms part of these Terms.
2. Acceptance and changes
By downloading, accessing or using the Service, you confirm you have read and agree to these Terms and our Health Disclaimer and Privacy Policy. We may update these Terms from time to time; when we do, we’ll change the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
3. Eligibility
You must be at least 18 years old to use NutriWealth. By using the Service, you confirm that you meet this requirement. NutriWealth is designed for generally healthy adults and is not intended for children or for anyone for whom calorie tracking or dietary change could be harmful.
4. Your data and your account
NutriWealth does not require you to create an account. The information you enter — your goals, logs and history — is stored on your own device. You are responsible for your device and for any data you keep on it. If you delete the App or your device data, that information is removed. See our Privacy Policy for details.
5. Licence to use the Service
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the App for your own personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved by us.
6. Images and content you submit
When you photograph a product, label or meal and submit it for analysis (“Your Submissions”): you confirm that you have the right to submit that image and that doing so does not break the law or infringe anyone else’s rights; you grant us a limited, worldwide, royalty-free licence to process Your Submissions for the sole purpose of providing you with the requested analysis and result (we do not retain your food photos after the analysis is returned); and you must not submit content that is unlawful, that infringes someone else’s rights, or that contains anything other than the food, product or label you want analysed.
7. Acceptable use
You agree not to: use the Service for any unlawful purpose or in breach of these Terms; copy, scrape, crawl, harvest, mirror, reverse-engineer, decompile, or attempt to extract the source code or underlying data of the Service, except to the extent the law expressly allows; use any automated means, including bots, scrapers, or tools that collect data for machine learning, AI, or model training, to access or extract any part of the Service or its content; interfere with, overload, or disrupt the Service or our backend, or attempt to bypass any security or access controls; remove, alter, or obscure any notices, branding, or attributions in the Service; resell, sublicense, or commercially exploit the Service or its content without our written permission; or use the Service to build or market any product or service that competes with it.
8. Health, safety and the limits of our information
NutriWealth provides general, educational information only and is not a medical device. It does not provide medical, dietary, nutritional, or health advice, and it does not diagnose, treat, cure, or prevent any condition. Health scores, calorie targets, and ingredient analyses are general estimates and opinions generated from third-party data and AI, which can be incomplete or inaccurate. You should always consult a qualified health professional before changing your diet or making health decisions — especially if you are pregnant, breastfeeding, under medical care, taking medication, have a medical condition or allergy, or have any history of disordered eating. Do not rely on NutriWealth to identify allergens; always check the actual product packaging. Our full Health Disclaimer sets out these limits in detail and forms part of these Terms.
9. Subscriptions, free trial and billing
NutriWealth is offered as a paid subscription, which may include a free trial.
- Free trial: NutriWealth Premium includes a 3-day free trial. You will not be charged during the trial. Unless you cancel before the trial ends, your subscription will begin automatically and you will be charged AUD $59.99 for the first year.
- Auto-renewal: the subscription is AUD $59.99 per year and renews automatically each year at the then-current price, unless you cancel at least 24 hours before the end of the current period.
- Payment: all purchases, trials, renewals, and refunds are processed by the Apple App Store or Google Play under their terms. We do not process or store your payment details.
- Managing or cancelling: you can manage or cancel at any time in your Apple or Google account settings. Cancelling stops future renewals; it does not retroactively refund the current period.
- Refunds: refund requests are handled by Apple or Google under their policies. Nothing here limits your rights under the Australian Consumer Law (Section 13).
Prices may change. A price change will not affect your current paid period and will apply from your next renewal.
10. Accuracy and third-party data
NutriWealth relies on third-party data sources and services, including Open Food Facts, USDA FoodData Central, Anthropic (AI analysis), and Cloudflare (infrastructure). We don’t control these third parties and aren’t responsible for the accuracy, availability, or content of their data. Product information, including barcode data, may be wrong, missing, or out of date, and AI analysis may produce errors. Always verify important information against the actual product packaging.
11. Intellectual property and attribution
The App, the Site, the NutriWealth name and logo, and all related design, text, graphics, and software (other than third-party data and content) are owned by us or our licensors and protected by intellectual property laws. You agree not to use our name, logo, or branding without permission, or to do anything that impairs our rights. The food and nutrition data shown in the App is sourced in part from Open Food Facts (used under the Open Database License, ODbL) and USDA FoodData Central (a public-domain U.S. government dataset). These sources remain the property of their respective contributors and are used under their applicable licences.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law: the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, and we don’t warrant that it will be uninterrupted, error-free, or secure, or that any result, score, or estimate is accurate or complete; we are not liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss arising from your reliance on the Service’s information, your diet or health decisions, or any inaccuracy in third-party data or AI output; and where our liability cannot lawfully be excluded, our total liability to you is limited, to the extent permitted by law, to the amount you paid us for the App in the 12 months before the claim (or, where no amount was paid, to AUD $100). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.
13. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. The limitations in these Terms apply only to the extent the law allows and do not affect those non-excludable rights.
14. Copyright complaints
We respect intellectual property rights. If you believe content in the Service infringes your copyright, contact us through the form at nutriwealth.app/support with details of the work, the allegedly infringing material, and your contact details, and we will review it.
15. Suspension and termination
You can stop using NutriWealth at any time by deleting the App. We may suspend or end your access if you breach these Terms or if we discontinue the App. Sections that by their nature should survive termination (including disclaimers, limitations of liability, intellectual property, and governing law) will continue to apply. If you uninstall the App, you will not be entitled to a refund of amounts already paid, except as required by law.
16. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. Nothing in this clause limits any right you may have to bring proceedings in your own jurisdiction where the law requires.
